Clients should review the relevant terms, pricing, recurring payment arrangements and cancellation information before completing payment.

Where a separate agreement or express consent is required by law, this will be obtained as appropriate.

Nothing in these Terms removes or limits statutory consumer rights.

3. Coaching Services

Ben Whitehead Coaching provides structured, personalised training and nutrition coaching based on a client's individual requirements.

Depending on the service purchased, coaching may include:

  • Personalised resistance training programmes.

  • Individual nutrition plans and general nutrition guidance.

  • Regular progress check-ins.

  • Training and nutrition adjustments.

  • Progress tracking and physique assessments.

  • Lifestyle, recovery and accountability support.

4. Client Eligibility and Health Information

Our standard coaching services are intended for adults aged 18 or over.

Coaching for clients under 18 may only be considered with appropriate parental or legal guardian consent and suitable safeguarding arrangements.

Before coaching begins, clients may be required to complete a detailed questionnaire covering training experience, goals, lifestyle, nutrition, physical limitations and relevant health information.

Clients agree to provide information that is accurate and complete to the best of their knowledge.

Clients should inform Ben Whitehead Coaching of significant changes to their health, medical circumstances, injuries or ability to exercise safely.

Where appropriate, medical clearance may be recommended or required before training begins or continues.

Ben Whitehead Coaching reserves the right to delay, modify or decline a service where there are reasonable concerns about suitability or safety.

5. Health and Medical Disclaimer

Ben Whitehead Coaching provides fitness training, physique development and general nutrition guidance.

We do not provide medical diagnosis, prescription services, medical treatment or medical nutrition therapy.

Our services are not a substitute for advice from a doctor, registered dietitian or other appropriately qualified healthcare professional.

Clients with existing medical conditions, significant injuries or concerns regarding their health should seek appropriate professional advice before commencing a training or nutrition programme.

Clients should stop exercising and seek appropriate medical attention if they experience concerning symptoms such as chest pain, fainting, severe dizziness or unusual breathlessness.

All exercise carries inherent risks. Clients should follow appropriate safety instructions and avoid activities beyond their current abilities.

Nothing in these Terms excludes or restricts liability for death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.

6. Client Responsibilities

Successful coaching requires consistency, honest communication and active participation.

Clients are expected to:

  • Follow agreed training and nutrition guidance responsibly.

  • Provide accurate progress updates and check-ins.

  • Inform their coach of relevant changes in circumstances.

  • Communicate injuries, illness or physical limitations.

  • Use exercise equipment safely.

  • Attend scheduled appointments on time.

  • Treat their coach and other individuals respectfully.

  • Use supplied coaching materials for their intended personal purpose.

Clients are responsible for their participation and day-to-day lifestyle decisions, subject to our responsibility to provide services with reasonable care and skill.

Failure to provide necessary updates or information may limit our ability to review progress or make appropriate programme adjustments.

7. Online Coaching and Programme Delivery

Online coaching is delivered remotely through agreed digital communication and coaching platforms.

Once payment and the required onboarding information have been received, we will confirm the expected commencement date and initial programme delivery arrangements.

The onboarding process may include:

  • Completion of a client intake questionnaire.

  • Review of training experience and current fitness levels.

  • Assessment of goals and available equipment.

  • Review of nutrition and lifestyle information.

  • Preparation of an individual coaching strategy.

Programme delivery and check-in arrangements will be explained as part of the selected service.

Clients should complete onboarding requirements promptly to avoid unnecessary delays.

If onboarding information is incomplete, programme preparation may be delayed. Any effect on the paid coaching period will be handled in accordance with the individual agreement and applicable consumer rights.

We will communicate any material delays caused by us and provide an appropriate remedy where required.

8. Coaching Support and Communication

Coaching support is provided through agreed communication channels, which may include email, messaging applications or coaching platforms.

Support is intended for coaching-related questions, training feedback, nutrition guidance and progress discussions.

Where unlimited support is included, this means clients may submit reasonable coaching-related enquiries without a fixed message allowance.

It does not mean guaranteed immediate responses or continuous 24-hour availability.

Response times may vary due to coaching commitments, time-zone differences, weekends, holidays and other reasonable circumstances.

We aim to maintain professional, consistent and timely communication throughout the coaching relationship.

9. Coaching Prices and Fees

The applicable price will be confirmed before a client purchases a service.

Our standard advertised prices may include:

Online Coaching

$195 USD per month.

Bodybuilding Competition Preparation

$325 USD per month.

One-to-One Personal Training

  • Single Session — $80 USD.

  • Eight-Session Package — $560 USD.

  • Twelve-Session Package — $780 USD.

Prices may be updated periodically or varied through individually agreed offers.

The price, currency, frequency of payment, applicable taxes and any additional charges will be clearly disclosed before the client commits to purchasing the service.

The price displayed at checkout or confirmed in the client's individual agreement will apply to that purchase.

Unless expressly included, coaching fees do not cover gym membership, equipment, supplements, food, competition entry fees, travel or other third-party expenses.

10. Payments and Stripe Subscriptions

Payments may be collected through Stripe or another authorized payment provider.

Monthly coaching subscriptions operate on an automatically renewing billing arrangement.

Unless otherwise specified before purchase:

  • The first payment is collected when the subscription begins.

  • Payments recur monthly on the billing date determined by the payment provider.

  • The subscription continues until cancelled.

  • There is no fixed minimum commitment beyond the current paid billing period.

  • The client authorises recurring payments to the payment method provided at checkout.

  • Future renewals may be cancelled through the available subscription management arrangements.

The recurring amount and billing frequency will be displayed before payment.

Clients are responsible for maintaining valid payment details and sufficient funds for agreed payments.

Stripe may provide invoices, receipts, payment notifications, renewal reminders and secure account-management facilities.

Payment information is processed in accordance with the payment provider's applicable terms and privacy practices.

11. Subscription Renewals and Price Changes

Monthly coaching subscriptions renew automatically unless cancelled before the next scheduled billing date.

The payment amount and renewal frequency will be disclosed before purchase.

We reserve the right to review or change the prices of our services.

Where a price increase affects an existing subscription, clients will receive advance notification, normally at least one full billing cycle before the new price takes effect.

Clients will have the opportunity to cancel before a revised price becomes applicable.

Any additional consent required by law will be obtained.

Price changes will not be applied retrospectively to billing periods already paid for.

12. Monthly Subscription Cancellations

Clients may cancel a monthly coaching subscription at any time.

Cancellations can be completed or requested through:

No telephone call or explanation is required to cancel a standard monthly subscription.

Unless otherwise agreed or required by law:

  • Cancellation takes effect at the end of the current paid billing period.

  • Future automatic renewals will stop.

  • Coaching access continues until the end of the paid period.

  • No additional cancellation penalty is charged.

  • Cancellation does not automatically entitle a client to a refund for services already supplied.

Cancellation requests should be made before the next scheduled renewal.

We will process valid requests promptly and provide confirmation or instructions where appropriate.

Clients retain any statutory cancellation or refund rights that apply independently of these subscription arrangements.

13. Refunds and Consumer Cancellation Rights

We aim to handle refund requests fairly, promptly and in accordance with applicable consumer protection law.

Coaching services involve personalized programme preparation, client assessment, communication and ongoing professional support.

The nature and extent of services already provided may be relevant when calculating an appropriate refund.

However, the fact that a service is personalized does not automatically remove statutory cancellation rights.

UK Customers

Where UK distance-selling consumer law applies, clients purchasing services remotely will generally have a statutory cancellation period of 14 days from the date the service contract is entered into, subject to applicable legal requirements and exceptions.

If a client expressly requests that coaching begin during this period, we may be entitled to charge a proportionate amount for services already supplied if the relevant legal conditions are satisfied.

Any request to begin services during a statutory cancellation period, and any legally required acknowledgement concerning cancellation rights, will be obtained separately where necessary.

Where the service has been fully performed and the relevant statutory requirements have been satisfied, the cancellation right may cease.

US and International Customers

Clients outside the UK may have additional or different cancellation and refund rights under applicable local laws.

Such rights will be respected and take precedence over conflicting provisions in these Terms.

Failure to Deliver Agreed Services

Where agreed services are not provided, are materially deficient or fail to meet applicable legal standards, the client may be entitled to an appropriate refund, price reduction, repeat performance or other remedy.

Refund requests should be sent to info@benwhiteheadcoaching.com.

Approved refunds will ordinarily be returned to the original payment method where possible.

14. Failed Payments and Outstanding Subscriptions

If a scheduled subscription payment fails, Stripe or the relevant payment provider may attempt to recover payment automatically.

This may involve further payment attempts and notifications asking the client to update their payment method.

During the recovery period, a subscription may be marked as past due.

Where payment remains outstanding, we may temporarily suspend future coaching services after appropriate communication, subject to the agreement and applicable law.

If all payment recovery attempts fail, the subscription may be cancelled.

Any outstanding balances will be handled in accordance with the agreed payment terms and applicable consumer law.

We do not impose undisclosed penalties for failed payments.

15. In-Person Personal Training

One-to-one personal training is provided at agreed locations, including Kissimmee Muscle in Kissimmee, Florida.

Sessions are subject to coach availability, scheduling arrangements and applicable facility rules.

Clients are expected to arrive punctually, wear suitable clothing and footwear, and follow reasonable exercise and equipment safety instructions.

Session Bookings and Rescheduling

We ask clients to provide at least 24 hours' notice when requesting to reschedule a session.

Where less than 24 hours' notice is provided or a client does not attend, the session may be treated as used only where that policy has been clearly disclosed and accepted before purchase and where it is fair and lawful in the circumstances.

Reasonable consideration will be given to emergencies, illness and exceptional circumstances.

If Ben Whitehead Coaching cancels an appointment, we will offer an alternative session or appropriate remedy.

Personal Training Packages

Package pricing and the number of sessions included will be confirmed before payment.

Any applicable package validity period, scheduling arrangements or cancellation conditions will be disclosed before purchase.

For prepaid training arrangements intended to fall within Florida's individual personal-trainer exemption, payment will not be accepted for sessions scheduled to be delivered more than 30 days after the payment date.

If an arrangement is subject to Florida health-studio legislation instead, any additional legally required contract terms, notices and cancellation rights will be provided before entering into that arrangement.

Refunds for unused sessions will be determined in accordance with the agreed package terms, services already provided and applicable consumer rights.

Gym Access

Kissimmee Muscle operates as a separate business.

Unless expressly confirmed otherwise, personal training fees do not include independent gym membership or unrestricted access to the facility.

Clients must comply with the gym's applicable rules and access requirements.

16. Bodybuilding and Competition Preparation

Bodybuilding competition preparation is a specialized coaching service which may involve detailed training, nutrition planning, physique assessments and preparation for a chosen event.

Depending on the agreed package, services may include:

  • Individual training programmes.

  • Bespoke nutrition planning and adjustments.

  • Regular physique assessments and check-ins.

  • Competition preparation guidance.

  • Peak-week planning.

  • Posing guidance where agreed.

The exact scope of competition preparation will be confirmed before purchase.

Clients are responsible for understanding the rules, eligibility requirements and prohibited substances regulations of their chosen competition federation.

Ben Whitehead Coaching does not prescribe controlled substances or provide medical supervision.

Clients should seek advice from qualified healthcare professionals regarding medications, hormones, medical conditions or other medical matters.

Competition placings, judging outcomes and specific physical results cannot be guaranteed.

We do not guarantee a particular amount of weight loss, muscle gain, body fat reduction or competition success.

We undertake to deliver the agreed services with reasonable care and skill.

18. Progress Photographs and Testimonials

Clients may provide progress photographs, physique videos, measurements and related information for coaching purposes.

This information will be handled privately and in accordance with our Privacy Policy.

We will obtain separate permission where required before publishing identifiable client photographs, testimonials, videos or transformation results.

Clients are not required to consent to marketing use of their information or images to receive coaching services.

19. Intellectual Property and Coaching Materials

Training programmes, nutrition documents, educational materials, coaching resources and other original content supplied by Ben Whitehead Coaching remain the intellectual property of Ben Whitehead Coaching or their relevant rights holders.

Without permission, clients must not:

  • Resell coaching programmes or resources.

  • Commercially reproduce or distribute materials.

  • Share private coaching documents publicly.

  • Represent our original materials as their own work.

  • Use our materials to provide paid coaching services to others.

Nothing in this section restricts rights which cannot lawfully be excluded.

Ben Whitehead Coaching aims to maintain a respectful and professional coaching environment.

We may suspend or terminate services in circumstances involving:

  • Serious or repeated breaches of agreed terms.

  • Abusive, threatening or inappropriate conduct.

  • Fraudulent activity.

  • Significant health or safety concerns.

  • Persistent non-payment.

  • Other circumstances making continued provision of the agreed service unreasonable or unsafe.

Where reasonably practicable, clients will be informed of concerns and given an opportunity to address them.

Any refund, credit or payment adjustment following termination will consider the circumstances, services already delivered and applicable legal obligations.

If we are unable to continue providing an agreed service, we will offer an appropriate alternative or remedy where required.

21. Liability and Limitations

Ben Whitehead Coaching agrees to provide coaching services with reasonable care, skill and professionalism.

We cannot guarantee specific physical results or outcomes.

Clients should exercise reasonable care when following programmes, using equipment and making decisions relating to their health and wellbeing.

Nothing in these Terms excludes or restricts liability for:

  • Death or personal injury caused by negligence.

  • Fraud or fraudulent misrepresentation.

  • Statutory consumer rights that cannot lawfully be excluded.

  • Any other liability which applicable law does not permit us to limit.

Any limitation of liability is subject to the laws and protections applicable to the client and service.

This may include contact details, training information, goals, progress reports, billing information and relevant health information.

We may use third-party providers, including Stripe, Wix, Google Forms and Google Sheets, to facilitate business operations, payments, questionnaires and coaching administration.

Where applicable law requires an additional lawful basis or explicit consent for processing sensitive information, this will be addressed separately.

23. Third-Party Platforms and Facilities

Ben Whitehead Coaching may use external services such as payment processors, coaching platforms, messaging applications and training facilities.

These providers may operate under their own terms, privacy policies and conditions of use.

Clients are responsible for complying with reasonable rules applicable to third-party facilities and platforms.

We are not responsible for the independent actions or operations of external providers where those matters are outside our reasonable control, but this does not remove our obligations in relation to services we have agreed to provide.

24. Changes to Services and Terms

We may update these Terms & Conditions to reflect changes to our services, payment systems, business practices or legal requirements.

Updated terms will be published on our website with the relevant revision date.

Material changes affecting an existing agreement will be communicated where required.

We will obtain additional agreement or consent where legally necessary.

Updates will not retrospectively remove rights already accrued under an existing agreement.

25. Applicable Law and Consumer Rights

Ben Whitehead Coaching provides services to clients in the United Kingdom, United States and other international locations.

The laws applicable to a particular agreement may depend on the business's legal establishment, the services supplied, the client's location and mandatory consumer protection rules.

Nothing in these Terms excludes rights or protections that cannot lawfully be waived.
